Welcome to PrometheusMail. These Terms of Service (Terms) govern your use of PrometheusMail’s services, website, and applications (collectively, the Services) operated by [COMPANY NAME] (we, us, or our).
By using our Services, you agree to these Terms. If you don’t agree, please don’t use our Services.
We’ve written these Terms in plain English wherever possible. Legal language is used only where necessary for clarity and enforceability.
Who can use PrometheusMail
You must:
- Be at least 18 years old
- Have legal capacity to enter contracts
- Use PrometheusMail for lawful business purposes only
- Represent a legitimate business entity
You may NOT use PrometheusMail:
- For personal/consumer use
- For illegal activities
- To send spam or unsolicited bulk email
- To harass, threaten, or harm others
- To violate intellectual property rights
Account registration
To use PrometheusMail, you must create an account. You agree to:
- Provide accurate, current information
- Maintain security of your credentials
- Notify us immediately of any unauthorized access
- Take responsibility for all activity under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Subscription plans and payments
PrometheusMail offers subscription plans (Starter, Pro, Business, Enterprise).
Payment terms
- Billed monthly or annually in advance
- Processed by Stripe
- In USD, EUR, GBP, or PLN
- Auto-renewal unless canceled
Free trial
- 14 days, no credit card required
- After trial, you must subscribe to continue
- Data retained for 30 days after trial expiration
Price changes
- We reserve the right to change pricing
- You’ll be notified at least 30 days in advance
- Changes apply to next billing cycle
Refunds
- Annual plans: prorated refund if canceled within 30 days
- Monthly plans: no refunds, but no cancellation fees

Service availability
We aim for 99.5% uptime. Service may be temporarily unavailable for:
- Scheduled maintenance (announced 48h in advance)
- Emergency maintenance (no advance notice)
- Causes beyond our control (force majeure)
Service Level Agreement (SLA) applies to Business and Enterprise plans only. See SLA document for details.
Your content and data
You retain ownership of all content you upload to PrometheusMail (emails, contacts, documents, messages).
You grant us a limited license to:
- Store and process your content to provide the Services
- Display your content to authorized users (your team)
- Back up your content for redundancy
We do NOT:
- Use your content to train AI models
- Sell or share your content with third parties
- Use your content for advertising
You’re responsible for:
- Ensuring you have rights to all uploaded content
- Compliance with GDPR when processing client data
- Not uploading illegal or harmful content
AI usage
PrometheusMail uses AI (Llama 3.3) to:
- Draft email replies
- Categorize messages
- Summarize conversations
- Provide context-aware suggestions
AI responses are generated based on your email content and knowledge base. You are responsible for reviewing AI-generated content before sending (in manual/semi-auto modes) or configuring appropriate automation rules (in autopilot mode).
We do not guarantee AI accuracy. You should review sensitive communications before sending.
Acceptable use
You may not:
- Reverse engineer the Services
- Attempt to bypass rate limits or security measures
- Access data you’re not authorized to access
- Resell or sublicense the Services
- Use the Services to compete with us
- Scrape or automate beyond provided APIs
- Send bulk unsolicited email (spam)
- Violate any applicable law
Violations may result in immediate account suspension.
Intellectual property
PrometheusMail owns
- The Services (software, interface, features)
- Our trademarks, logos, and branding
- Our proprietary algorithms and AI training
- Marketing and educational content we create
You own
- Your content and data
- Your client data
- Your account configuration
Open source
- Parts of PrometheusMail use open source software
- See /credits for full attribution
Termination
You can cancel anytime
- Log into account settings
- Click “Cancel subscription”
- Access retained until end of billing period
- Data retained for 30 days, then deleted
We can terminate your account if you
- Violate these Terms
- Fail to pay within 14 days of due date
- Use the Services fraudulently
- Engage in illegal activity
After termination
- Immediate loss of access
- Data retained for 30 days (recoverable)
- After 30 days: permanent deletion
Disclaimers and liability
SERVICES PROVIDED “AS IS”: PrometheusMail is provided without warranties of any kind, express or implied.
We don’t guarantee:
- Error-free operation
- Specific AI response quality
- Compatibility with all third-party tools
- Uninterrupted availability
Limitation of liability
To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for:
- Indirect, incidental, or consequential damages
- Lost profits or data (outside our direct control)
- Third-party actions affecting our Services
- Your misuse of AI-generated content
EU consumer rights
Nothing in these Terms limits your statutory rights under EU consumer protection law.
Indemnification
You agree to indemnify and hold PrometheusMail harmless from claims arising from:
- Your violation of these Terms
- Your violation of applicable laws
- Your content infringing third-party rights
- Your misuse of the Services
Changes to these Terms
We may update these Terms. Material changes:
- Notified via email at least 30 days in advance
- Continued use after effective date = acceptance
- If you disagree, you can cancel your subscription

Governing law and disputes
These Terms are governed by Polish law.
Any disputes will be resolved through:
- Good-faith negotiation (30 days minimum)
- Mediation (if negotiation fails)
- Polish courts (Katowice) as last resort

Entire agreement
These Terms + Privacy Policy = full agreement between us.
Severability
If any provision is unenforceable, other provisions remain valid.
No waiver
Our failure to enforce a right doesn’t waive future rights.
Assignment
You cannot transfer your rights without our consent. We may transfer our rights (e.g., in an acquisition).
Force majeure
Neither party is liable for delays caused by events beyond reasonable control.
